Vote NO on Proposition 90 (Eminent Domain)

Few groups can claim to have done more to protect private property rights than the California Association of Realtors (C.A.R.) and it’s Realtor members. That's what makes C.A.R.'s opposition to Proposition 90 so profound.

In taking it's position, C.A.R. recognizes many of the measure's shortcomings including the restrictions it will place on the ability of local governments to do good land use planning.

One of the most onerous provisions of Proposition 90 deals with "Downzoning Property" (government decisions that reduce the amount of development permitted on a parcel). This section of Proposition 90 could force local governments in the Yuba-Sutter area to pay HUNDREDS OF MILLIONS OF DOLLARS to developers and their attorneys.

Yuba County could be guilty of downzoning if it restricts development in the River Highlands General Plan area in an effort to save Beale Air Force Base. The County's General Plan now permits low density residential development just Northeast of Beale.
We have seen a disturbing trend toward monster homes on small lots with inadequate parking. In one case, a builder is putting 3,596 square foot, five bedroom homes with two car garages on lots that only have enough room to park one car on the street. Local governments that create new design standards to deal with this problem would likely be guilty of downzoning.

Sutter County created the "Ranchette" zone in about 1996 in an effort to preserve agricultural land. Unfortunately, this relatively new zoning device has had very mixed results. Efforts to limit it's use would be another form of downzoning that could result in payments to landowners.

It becomes easier to appreciate the magnitude of this situation when you understand that a 25 acre parcel on Stabler Lane recently sold for about seven and a half million dollars and that was just one, unimproved parcel zoned for single family homes.

We need legislation to protect citizens from the abusive use of eminent domain by the government. Unfortunately, Proposition 90 is a poorly crafted measure that creates more problems than it solves.
